Terms of Service

1. Who we are

ClimbMetrics ("we", "us", "the Service") is operated by a sole trader based in the United Kingdom. You can contact us at support@climbmetrics.co.uk. By creating an account or using the Service, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. The Service

ClimbMetrics provides keyword rank tracking, on-page site audits, AI-generated SEO recommendations, local industry reporting, competitor tracking, AI Visibility Tracking, Google Business Profile analysis, and related features for websites you own or are authorised to analyse.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information and notify us promptly of any unauthorised use. You must be at least 18 years old and using the Service for business purposes.

4. Acceptable Use

You agree not to: (a) track, audit, or analyse websites you do not own or have permission to analyse; (b) reverse engineer, copy, or attempt to extract the source code of the Service; (c) resell or provide access to the Service without our written agreement; (d) submit unlawful, infringing, or harmful content; or (e) use the Service in a way that disrupts or overloads it.

5. Subscriptions, Trials & Billing

Paid plans (currently Pro at £39/month or £390/year, and Pro+ at £89/month or £890/year) are billed in advance on a recurring basis through our payment provider, Stripe. Prices are inclusive of VAT where applicable.

Where a free trial is offered, it lasts 7 days. You must provide payment details to start a trial. Unless you cancel before the trial ends, your paid subscription begins automatically and the applicable fee is charged. Subscriptions renew automatically until cancelled.

You can cancel at any time from the Billing page. Cancellation takes effect at the end of your current billing period, and you retain access until then. Except where required by law, fees already paid are non-refundable.

6. Your statutory cancellation rights

If you are a consumer in the UK, you may have a legal right to cancel within 14 days of subscribing under the Consumer Contracts Regulations 2013. Because the Service provides digital content and services that begin immediately, by starting to use the Service during this period you acknowledge that you may lose this cancellation right once the service has been fully performed. Nothing in these Terms affects your non-excludable statutory rights.

7. Third-Party Services

The Service relies on third-party providers, including Stripe (payments), Supabase (database, authentication and storage), Resend (email delivery), OpenAI (AI-generated recommendations), Perplexity (AI Visibility Tracking), Google (Search Console and Business Profile connections, where you choose to connect them), Cloudflare (bot protection), Firecrawl (site crawling), and Railway (hosting). Your use of the Service is also subject to those providers' terms where applicable.

8. Intellectual Property

The Service, including all software, design, and content (excluding your data and content you submit), is owned by ClimbMetrics or its licensors and protected by intellectual property laws. You retain ownership of the data and content you submit; you grant us a licence to process it solely to provide the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. Search engine rankings, audit scores, and AI recommendations are estimates and informational only — they are not guarantees of rankings, traffic, or business outcomes.

10. Limitation of Liability

Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, and to the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the amount you paid to us in the twelve months preceding the claim. We are not liable for indirect or consequential losses, or loss of profits, revenue, or data.

11. Termination

We may suspend or terminate your account for breach of these Terms. You may close your account at any time from Settings; closure deletes your data subject to the retention periods described in our Privacy Policy.

12. Changes

We may update these Terms from time to time. Material changes will be notified by email or in-app. Continued use after the effective date constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
